1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of StormLead (the “Service”), operated by StormLead LLC (“StormLead,” “we,” “us”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms on behalf of yourself and, if applicable, the company you represent (“Customer”). If you do not agree, do not use the Service.
2. Description of Service
StormLead is a business-to-business platform that helps roofing companies identify storm-damaged properties, manage sales leads, and coordinate field sales activity across a web dashboard and mobile app.
3. Eligibility & Accounts
- You must be at least 18 years old and authorized to act on behalf of your company to create an account.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- Company admins are responsible for the conduct of the sales representatives and other users they invite to their account.
4. Subscriptions, Billing & Cancellation
- Paid plans are billed on a recurring basis through our payment processor, Stripe.
- You may cancel at any time from the billing settings in the web dashboard. Cancellation stops future billing; your subscription remains active through the end of the period you’ve already paid for.
- Payments are non-refundable. We do not provide prorated or partial refunds for unused time in a billing period.
- We may change subscription pricing with advance notice; continued use after a price change takes effect constitutes acceptance.
5. Acceptable Use
You agree not to, and not to permit your users to:
- Use the Service to send SMS or email communications to a homeowner without a valid, lawfully obtained consent record, or in violation of the Telephone Consumer Protection Act (TCPA) or similar laws.
- Use the Service in connection with any unlawful, deceptive, or unauthorized solicitation, including in violation of state licensing, door-to-door solicitation, or trespassing laws. You are solely responsible for your field representatives’ conduct while canvassing.
- Attempt to access another company’s data, reverse-engineer the Service, or interfere with its normal operation.
- Resell, sublicense, or provide access to the Service to any third party outside your own company without our written consent.
- Upload unlawful content or data you do not have the right to enter into the system.
6. Customer Data
As between you and StormLead, you (or your company) own the lead, property, and contact data you enter into the Service. We process this data on your behalf to operate the Service, as described in our Privacy Policy. You are responsible for the accuracy of the data you enter and for obtaining any consents required to lawfully collect and use it.
7. Intellectual Property
The Service, including its software, design, and branding, is owned by StormLead and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes during your subscription term. You retain no rights to the Service itself.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Storm and property data is sourced from third-party providers (e.g., NOAA, ATTOM) and provided for informational purposes only — we do not guarantee its accuracy or completeness, and it should not be the sole basis for a business or contracting decision.
9. Limitation of Liability
To the maximum extent permitted by law, StormLead will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim arose.
10. Termination
You may cancel your account at any time. We may suspend or terminate your access for violation of these Terms, non-payment, or as needed to protect the Service or other users. Upon termination, your right to use the Service ends immediately; data handling after termination follows our Privacy Policy.
11. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be brought in the state or federal courts located in Arizona, and you consent to their jurisdiction.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
